Rafael Domingo, president of the Maiestas Foundation, recently published a book, "¿Qué es el derecho global?" (“What is Global Law?”), as part of the Thomson Reuters Aranzadi Global Law Collection. The book is already an award-winner, receiving Rafael Martínez Emperador Prize from the Spanish General Council of the Judiciary.In this work, the author lays out the key lines of thought regarding, as he sees it, the developing body of “Global Law”, which goes beyond modern International Law and the ancient Law of Nations. After an introductory historical overview, in which he evidences how “each era has its own law”, he provides a grounded explanation of the basic principals underpinning the idea of “Global Law” and how this developing global legal order can be distinguished from other past and present legal orders. Prof. Domingo focuses our attention on the fact that “Global Law” is anchored in the concept of the individual person (and not that of the traditional nation state), an approach which better reflects the realities of the profoundly globalized society in which we live today.
Full of original thought, as well as an enjoyable read, the book (as the author himself mentions) "is written to be read in a single sitting, and attempts to not leave any reader indifferent to this important challenge of the 21st century, the challenge of Global Law".
